Dear Sir,

We make the following submission within the time specified and

suggest that a closing date of 28-12 is deliberately setting out to

unconvinced the public.

The development proposed i.e. Bring gas from the sea well to Craughwell,

significantly impacts on numerous Special Areas of Conservations and Natura 2000 qualifying sites, it is

mandatory under the Habitats Directive for alternatives which do not impact on

Special Areas of Conservations and qualifying sites to be addressed, they have not been.

We can find no act or regulation in Irish Law which gives the Minister of the

Marine and Natural Resources the right to give a consent to a land based private

development of a gas pipeline on land. This is a matter under The Habitats

Regulations for the Planning Authority.


For a Regulation made under the European Communities Act to be valid it must

be implementing the Directive, we question the validity of the S.I.517 of 2001

and legal advice is being taken.


The Environmental Impact Assessment Directive and Regulations require that the

data necessary to make an assessment be submitted, it has not been, there is

an assessment of the data by the consultants submitted, this is not valid.

Notwithstanding the above legal arguments we submit that the holding an oral

hearing into this Environmental Impact Statement without the submission of the

DATA and giving interested parties the correct time to asses this data, would not

be within the Environmental Impact Assessment Directive and Regulations.


Finally we submit that the Minister of the Marine and Natural

Resources has disqualified himself from making an objective

assessment of this proposed development, by his many bullish and

inaccurate statements in it's favor and by his interference in the

planning assessment by Mayo County Council of the planning

application for the Gas Terminal.
